Frequently Asked Questions

Florida Spearfishing Regulations

Spearfishing regulations in Florida are designed to ensure the sustainable and responsible harvest of marine resources while preserving the state’s diverse aquatic ecosystems. Individuals engaging in spearfishing activities are typically required to possess a valid saltwater fishing license, with additional endorsements or permits possibly necessary for specific species. Regulations dictate the types of spear guns and spears that can be used, and there may be restrictions on the use of powerheads or other spearfishing gear. Divers are mandated to display a diver-down flag to alert boaters to their presence. Specific rules apply to various fish species, including size limits, bag limits, and seasonal closures to protect vulnerable populations during critical times. Additionally, spearfishing is often prohibited in designated areas, such as no-harvest zones and certain freshwater bodies.

Do You Need a Fishing License to Spearfish in Florida?

You only need a regular saltwater fishing license, available for purchase on the FWC website. If you’re fishing on a charter, they will provide the license for you.

What Fish can you not Spearfish in Florida?

In Florida, there are specific regulations concerning spearfishing that prohibit the spearing of certain fish species to protect their populations and maintain ecological balance. Here are some, not all, of the fish that you cannot spear in Florida waters:

  1. Billfish (such as marlin and sailfish) – These are protected due to their sport value and declining population numbers.
  2. Spotted Eagle Ray – Protected due to their unique status and relatively low numbers.
  3. Sturgeon – These are ancient fish with strict protections to aid in their recovery from overfishing.
  4. Manta Ray – Like the spotted eagle ray, these are also protected due to their low numbers and ecological importance.
  5. Sharks – There are specific regulations and protections in place for sharks due to overfishing and their role as apex predators.
  6. Goliath Grouper – This species is protected from all harvest in Florida waters due to its critically low numbers.
  7. Tarpon – Highly prized for sport fishing, tarpon cannot be harvested or speared.
  8. Bonefish – These are catch-and-release only due to their sport fishing value.
  9. Nassau Grouper – This species is protected to help recover its populations from overfishing.

It’s important for anyone interested in spearfishing to check the most current regulations, as laws and regulations can change.
